Bezwaar: Dutch Immigration Appeal Process Guide
When the Dutch Immigration and Naturalisation Service (IND) issues an unfavourable decision, you have the right to file an objection or administrative petition review (bezwaar). A bezwaar is a formal administrative remedy that asks the IND to review and reconsider its own decision. It is often the most effective first step to protect your residence rights before considering an appeal in court.
Understanding Bezwaar in Dutch Immigration Law
A bezwaar is a formal administrative remedy that asks the IND to review and reconsider its own decision. It is often the most effective first step to protect your residence rights before considering an appeal (beroep) in court.
In most scenarios, immigration lawyers recommend settling the legal case in the bezwaar procedure because it costs less time and money to applicants. A court case could easily last for months or even years. Even if a case is won in court, compensation of legal costs is usually not full.
Why Choose Bezwaar?
- Faster resolution than court appeals
- Lower costs and legal fees
- Better chance of favorable outcome
- Preserves residence rights
Why and When to File a Bezwaar
A bezwaar is appropriate when the IND makes decisions that negatively impact your immigration status
Negative Decision on Application
Rejection of a new residence permit or an extension request due to disputed grounds or insufficient evidence.
Withdrawal of Residence Permit
The IND decides to revoke an existing permit due to alleged non-compliance, criminal records, or changes in circumstances.
Incorrect Application of Law or Facts
The IND may have overlooked crucial evidence or misapplied Dutch or EU immigration regulations, resulting in an unlawful decision.
Legal Framework and Deadlines
Understanding the critical legal requirements for a valid bezwaar
Time Limit
In most cases, a bezwaarschrift must be submitted within 4 weeks from the date stated on the decision letter (datum van kennisgeving).
Form & Language
The objection must be written in a recognised language by the IND and clearly labeled as a bezwaarschrift.
Legal Grounds
It is not enough to say you disagree; the objection must include specific legal arguments, citing relevant laws, regulations, or case law.
Supporting Evidence
Attach all documents and new information that strengthen your case.
Critical Warning
Missing the deadline or failing to include legal reasoning can result in the objection being declared inadmissible (niet-ontvankelijk).
Step-by-Step Bezwaar Procedure
A clear, structured process to challenge IND decisions effectively
Filing the Bezwaar
Submit a written bezwaarschrift to the IND within the 4-week period.
Acknowledgement of Receipt
The IND confirms receipt and reviews whether the objection is complete.
Hearing (Hoorzitting), if Applicable
In some cases, you will be invited to explain your arguments in person, especially in cases involving private and family life or loving relationships.
Duration & Decision
The IND generally decides within 19 weeks, but this can be extended for complex cases. If the IND exceeds the statutory period without good reason, you may send a formal notice of default (ingebrekestelling).
Residence Rights During the Procedure
In most immigration matters, if the bezwaar is filed on time, your lawful stay is automatically extended until a decision is reached. You remain legally in the Netherlands and might continue working if your existing work rights allow it.
However, this is not guaranteed. In some cases, the IND may prohibit the person in question from staying in the Netherlands during the bezwaar procedure. To tackle this, the person will have to submit an interim measure request (voorlopige voorziening) to suspend the return decision issued by the IND.
Protection Options
Automatic Extension
Lawful stay extended until decision
Work Rights Maintained
Continue working if previously allowed
Interim Measures
Voorlopige voorziening if return ordered
Possible Outcomes and Consequences
Understanding what happens after the IND reviews your bezwaar
Successful Bezwaar
- The IND revokes or amends the negative decision
- Your residence permit is granted or restored
- You may be entitled to schadevergoeding (financial compensation) for undue delay or wrongful decision
Unsuccessful Bezwaar
- The original decision stands
- The IND may issue a terugkeerbesluit (return decision) requiring you to leave immediately or within a short period
- An inreisverbod (entry ban) can be imposed, restricting re-entry into the Schengen Area for 1-5 years
- You can still appeal to the administrative court (beroep), but the process becomes longer and costlier
